These Booking Terms & Conditions apply to speaking engagements, keynote presentations, workshops and other services provided by Theo Venter (“Theo”) to the person, business or organisation making the booking (“the Client”).
By confirming a booking, paying a deposit or booking fee, or accepting these terms through Theo’s website, the Client agrees to the following conditions.
All bookings are subject to Theo’s availability. You must have written confirmation from Theo that he is available for your event before completing the booking form.
A booking is only considered confirmed once:
Until these requirements have been met, Theo may accept another booking for the requested date.
Once confirmed, the date will be reserved for the Client and Theo may decline other engagements for that date.
The Client agrees to pay the speaking, workshop or engagement fee specified at the time of booking.
Unless otherwise agreed in writing, a deposit of $1,000 is required to secure the booking, with the remaining balance due 7 days before the event arrival date.
All fees are quoted in Australian dollars and include GST, unless otherwise stated.
Any additional costs agreed between Theo and the Client, including approved travel or accommodation expenses, will be payable by the Client.
For engagements outside the Perth metropolitan area, reasonable travel-related expenses are the responsibility of the Client unless otherwise agreed in writing.
Depending on the location and requirements of the engagement, these expenses may include:
Travel arrangements will be made by the Client unless otherwise agreed in writing.
Where overnight accommodation is reasonably required due to the location or timing of the engagement, suitable accommodation must be provided for Theo.
International engagements may be subject to additional travel requirements and costs, which will be agreed with the Client before the booking is confirmed.
Theo will make every reasonable effort to arrive at the venue in sufficient time to deliver the agreed engagement.
Theo will not be responsible for delays or inability to attend caused by circumstances reasonably outside his control, including flight cancellations or delays, severe weather, road closures, traffic incidents, transport disruption or other unforeseen travel circumstances.
If a significant travel disruption occurs, Theo and the Client will work together in good faith to identify a reasonable alternative where possible, which may include adjusting the presentation time, delivering the presentation virtually or rescheduling the engagement.
Unless otherwise agreed in writing, the Client is responsible for arranging and paying for the venue and all associated event costs.
The Client is responsible for ensuring Theo has reasonable access to the venue before the presentation for setup, preparation and audio-visual checks.
The Client must provide accurate event information, including the venue, presentation time, expected audience, event format and primary event contact.
Any significant change to the agreed event date, location, presentation format, duration or audience should be discussed with Theo as soon as possible and may be subject to additional fees.
The Client is responsible for providing suitable audio-visual equipment appropriate to the venue and audience size.
Unless otherwise agreed, Theo may require:
Specific technical requirements can be confirmed with the Client or venue before the engagement.
When Theo accepts a confirmed engagement, the date is reserved for the Client and other potential bookings may be declined.
If the Client cancels a confirmed engagement:
Any non-refundable or unrecoverable travel, accommodation or other expenses already incurred in connection with the engagement will also be payable by the Client.
If an engagement cannot proceed because of an act, omission, decision or failure by the Client, its representatives, venue or agents, this will be treated as a cancellation by the Client.
The Client may request to transfer a confirmed engagement to another date.
Any rescheduling is subject to Theo’s availability and must be agreed in writing.
Where Theo agrees to a rescheduled date, all payments already made will be transferred to the new engagement date rather than refunded.
A $300 REBOOKING FEE may apply where significant additional administration, travel changes or costs are incurred.
The rescheduled engagement must take place within 12 months of the original event date unless otherwise agreed.
If Theo is unavailable for the Client’s proposed replacement date, or the Client elects not to proceed with a replacement date, the cancellation provisions above will apply.
Where the Client books Theo for multiple events, presentations or dates, each confirmed date will be considered a separate engagement for the purpose of cancellation or rescheduling unless the booking confirmation expressly states otherwise.
Cancellation or rescheduling of one engagement does not automatically cancel or reschedule any other confirmed engagement.
Theo’s presentations and workshops may not be filmed, recorded, livestreamed, broadcast, reproduced or distributed in full without Theo’s prior written consent.
Where recording of Theo’s presentation has been approved, the permitted purpose, format, duration of use and distribution must be agreed with Theo in advance.
The Client is responsible for taking reasonable steps to ensure audience members do not record, reproduce, livestream or distribute Theo’s presentation without permission.
Theo may arrange for his own photographer, videographer or content creator to attend an engagement for the purpose of capturing photography, video and promotional content.
Where Theo intends to bring a photographer or videographer, reasonable notice will be provided to the Client. Their attendance will be subject to the venue’s reasonable access, security, safety and accreditation requirements.
Unless otherwise agreed, any costs associated with Theo engaging his own photographer, videographer or content creator will be Theo’s responsibility.
Theo and his content creator will make reasonable efforts to minimise disruption to the event and comply with any reasonable photography, privacy or confidentiality requirements communicated by the Client in advance.
Where the Client engages a professional photographer or videographer for the event, Theo may request access to professional photographs or video footage featuring Theo.
The Client agrees to make reasonable efforts to provide Theo with access to suitable high-resolution photographs and/or approved video footage following the event, subject to the Client having the necessary rights and permissions to do so.
Where supplied, the Client grants Theo permission to use the approved photographs or footage featuring Theo for reasonable business and promotional purposes, including Theo’s website, social media, speaker materials, showreels, proposals, advertising and other marketing communications, unless otherwise agreed in writing.
Where required, appropriate photographer or videographer credit will be provided.
The Client remains responsible for ensuring that it has sufficient permission from its photographer, videographer and any relevant third parties to provide the material and grant these usage rights.
The Client may use approved event photographs featuring Theo for reasonable purposes connected with promoting or reporting on the event, including the Client’s website, social media and internal communications.
Any use of Theo’s image or likeness for paid advertising, commercial endorsements or promotional campaigns unrelated to the booked event requires Theo’s prior written approval.
All intellectual property associated with Theo’s presentations, workshops and materials remains the property of Theo Venter or the relevant rights holder.
This includes, without limitation, presentation content, slides, stories, frameworks, exercises, written materials, videos and other resources supplied as part of an engagement.
Booking Theo does not transfer ownership of, or grant the Client a licence to reproduce, distribute, sell, publish or adapt, any of Theo’s intellectual property unless expressly agreed in writing.
Any significant change to the agreed scope of the engagement must be approved by Theo in writing.
This includes changes to the event date, venue, presentation length, number of sessions, delivery format or other material booking requirements.
Additional services or substantial changes requested after confirmation may incur an additional fee.
Neither Theo nor the Client will be responsible for failing to perform an obligation where performance is prevented by circumstances genuinely outside that party’s reasonable control.
This may include serious illness or injury, natural disasters, extreme weather, government restrictions, major transport disruption, venue closure, civil emergency or other comparable unforeseen events.
Where such circumstances prevent the engagement from proceeding, Theo and the Client will work together in good faith to determine whether the engagement can reasonably be rescheduled, relocated or delivered in another format.
Any treatment of payments, refunds or unrecoverable expenses will be determined having regard to the circumstances and any costs already reasonably incurred.
In the unlikely event that Theo is unable to fulfil a confirmed engagement, he will notify the Client as soon as reasonably possible.
Where appropriate, Theo and the Client may agree to reschedule the engagement.
If Theo cancels the engagement and no suitable alternative arrangement can be agreed, any engagement fees already paid for services not provided will be refunded.
Theo will not be responsible for indirect or consequential losses arising from cancellation where the cancellation was caused by circumstances reasonably outside his control.
To the extent permitted by law, Theo will not be liable for indirect, incidental, special or consequential loss arising from an engagement or its cancellation, delay or rescheduling.
Nothing in these terms is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded under applicable Australian law.
Any amendment to a confirmed booking or these terms must be agreed in writing by Theo and the Client.
Handwritten amendments or changes made unilaterally by either party will not be binding unless accepted in writing by the other party.
These Booking Terms & Conditions are governed by the laws of Western Australia, Australia, and the parties submit to the jurisdiction of the courts of Western Australia.
By confirming the booking, making the required payment or selecting the acceptance checkbox during the online booking process, the Client confirms that they have read, understood and agree to these Booking Terms & Conditions.
